Résumé

En matière d’interprétation juridique, l’hypothèse du silence de la loi renvoie à l’indétermination sémantique du droit. C’est du moins ainsi que la jurisprudence et la doctrine ont principalement conceptualisé la thèse de l’indétermination, soit en affirmant la primauté du texte législatif sur la règle de droit, et ce, malgré la nécessité de distinguer le texte de la norme. Le présent article réaffirme le nécessaire dépassement de la formulation sémantique de l’indétermination du droit, laquelle doit plutôt être comprise de manière pragmatique. Le problème interprétatif est, dès lors, conçu en insistant sur l’usage du droit plutôt que sur le recours aux règles interprétatives. En cela, le problème de l’indétermination du droit et, corrélativement, celui du silence de la loi sont envisagés en fonction de l’application pragmatique du droit et au-delà de la réponse apportée par l’herméneutique juridique. L’approche pragmatique proposée ici consiste à déplacer l’organisation de la fonction de juger vers d’autres formes de régulation sociale au lieu de la maintenir dans l’opération mentale du juge.

Abstract

In the field of legal interpretation, the hypothesis of the silence of the law refers back to the semantic indetermination of the law. This is, at least, how jurisprudence and doctrine have mainly conceptualized the thesis of indetermination, by affirming the primacy of the legislative text over legal rules despite the need to distinguish between the text and the norm. This paper reiterates the need to go beyond a semantic formulation of the indetermination of the law, which must be understood more pragmatically. The interpretative problem is, as a result, defined by emphasizing the use of the law, rather than the recourse to interpretative rules. The problem of the indetermination of the law and, as a corollary, the silence of the law, are considered on the basis of the pragmatic application of the law beyond the response provided by legal hermeneutics. The pragmatic approach proposed here involves moving the organization of judging as a function towards other forms of social regulation, rather than maintaining it as part of a judge’s mental process.

Resumen

En materia de interpretación jurídica, la hipótesis del silencio de la ley remite a la indeterminación semántica del derecho. Es al menos así como la jurisprudencia y la doctrina han conceptualizado principalmente a la tesis de la indeterminación, afirmando la primacía del texto legislativo sobre la regla de derecho, y esto, a pesar de la necesidad de distinguir el texto de la norma.  Este artículo reafirma la necesaria superación de la formulación semántica de la indeterminación del derecho, que más bien tiene que ser comprendida de manera pragmática. Por consiguiente, el problema interpretativo se concibe en la insistencia sobre el uso del derecho, en vez de hacerse sobre el recurso de las reglas interpretativas. En ello, el problema de la indeterminación del derecho y correlativamente al del silencio de la ley, es materia de reflexión en función de la aplicación pragmática del derecho, y aún más allá de la respuesta brindada por la hermenéutica jurídica. El enfoque pragmático que aquí se propone consiste en desplazar la organización de la función de juzgar hacia otras formas de regulación social, en vez de mantenerla en la operación mental del juez.
